PRELIMINARY DOCKET: Examiner Hearing for Thursday, November 05, 2020

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. Order No. R-21292 further pooled the uncommitted interests in the Bone Spring formation (Grama Ridge; Bone Spring NE Pool, Code 28435) and dedicated the Unit to the Inland 26/23 B2OJ State Com #1H well, to be horizontally drilled from a surface location in Unit P in Section 26 to a bottom hole location in Unit J in Section 23, Township 21 South, Range 34 East. The above-referenced unit will be dedicated to the proposed initial CB TANO 26 35 FEE 11 301H Well, to be horizontally drilled from a surface hole location in the NE/4 NE/4 (Unit A) of Section 26 to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 35. The completed interval for the proposed CB TANO 26 35 FEE 11 301H Well will be within 330’ of the quarter-quarter line separating the W/2 E/2 and the E/2 E/2 of Sections 26 and 35 to allow inclusion of this acreage into a standard 640-acre horizontal well spacing unit. The proposed 640-acre standard horizontal spacing unit will overlap two existing 160-acre horizontal spacing units in the Culebra Bluff; Bone Spring, South Pool (Pool Code 15011) approved under Division Orders R-13750 and R-13773, which are currently dedicated to the Layla 35 PA 001H well (API No. 30-015-40967), and the Layla 35 OB 001H well. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the well. Said area is located approximately 3 miles southeast of Loving, New Mexico.
13. 21487 Application of Chevron Production Company for an overlapping horizontal spacing unit in the Wolfcamp formation and compulsory pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order (1) approving a 640-acre, more or less, overlapping spacing unit in the Wolfcamp formation (Purple Sage; Wolfcamp (Gas) Pool), and (2) pooling all uncommitted interests in the proposed horizontal spacing unit comprised of the E/2 of Sections 26 and 35, Township 23 South, Range 28 East, NMPM, Eddy County, New Mexico. The above-referenced unit will be dedicated to the following proposed wells:
•    The CB TANO 26 35 FEE 11 401H Well to be horizontally drilled from a surface hole location in the NE/4 NE/4 (Unit A) of Section 26 to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 35; and
•    The CB TANO 26 35 FEE 11 402H Well and the CB TANO 26 35 FEE 11 403H Well, both are to be horizontally drilled from surface hole locations in the NE/4 NE/4 (Unit A) of Section 26 to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 35.
Pursuant to the Special Rules for the Purple Sage; Wolfcamp (Gas) Pool (Pool Code 98220), the completed interval for each of these proposed initial wells will comply with the 330-foot setback requirement. The proposed 640-acre standard horizontal spacing unit will overlap an existing 320-acre standard horizontal spacing unit in the Purple Sage; Wolfcamp (Gas) Pool approved under Division Order R-13872 that is comprised of the E/2 of Section 35, and that is currently dedicated to the Layla 35 W2OB 3H well (API No. 30-015-42407) which has been drilled from the SW/4 SE/4 (Unit O) of Section 35. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the well. Said area is located approximately 3 miles southeast of Loving, New Mexico.
14. 21488 Application of Spur Energy Partners, LLC for compulsory pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted mineral interests in the Yeso formation in a 320-acre, more or less, standard (proximity tract) horizontal spacing unit comprised of the S/2 of Section 3, Township 17 South, Range 30 East in Eddy County, New Mexico. 15. 21489 Application of Apache Corporation for compulsory pooling, Eddy County, New Mexico. Applicant seeks an order from the Division: (1) approving the creation of a horizontal spacing unit for wells located within its proposed Taco 28/30 Development Area in the Designated Potash Area; and (2) pooling all uncommitted mineral interests within a Bone Spring horizontal spacing unit underlying the S/2 N/2 of Section 28, S/2 N/2 of Section 29, and S/2 NE/4 of Section 30 of Township 20 South, Range 30 East, N.M.P.M., Eddy County, New Mexico. Said horizontal spacing unit is to be dedicated to the proposed Lone Tree Draw 14-13 State Com 332H Well, an oil well, to be horizontally drilled from a surface location in SW/4 NW/4 (Unit E) of Section 14 to a bottom hole location in the NE/4 NE/4 (Unit A) of Section 13. This Well defines the HSU. Also proposed are the following infill wells: the Lone Tree Draw 14-13 State Com 331H Well, an oil well, to be horizontally drilled from a surface location in the NW/4 NW/4 (Unit D) of Section 14 to a bottom hole location in the NE/4 NE/4 (Unit A) of Section 13, and the Lone Tree Draw 14-13 State Com 333H Well, an oil well, to be horizontally drilled from a surface location in the SW/4 NW/4 (Unit E) of Section 14 to a bottom hole location in the SE/4 NE/4 (Unit H) of Section 13. The completed interval and first take and last take point for the wells proposed in the unit meet the Division’s statewide setback requirements for horizontal oil wells; Devon will utilize proximity tracts. 49. 21525 Application of COG Operating LLC to pool additional interest owners under Order No. R-21102-A, Eddy county, New Mexico. Applicant in the above-styled cause seeks an order for the limited purpose of pooling additional unleased mineral interest owners under the terms of Division Order No. R-21102-A. The Division entered Order No. R-21102 in Case No. 20935 on February 12, 2020, which created a 767.52-acre, more or less, standard horizontal spacing unit comprised of the W/2 of Sections 22 and 27, and the N/2 NW/4 and Lots 1-2 (W/2 equivalent) of irregular Section 34, Township 26 South, Range 28 East, Eddy County, New Mexico (“Unit”), and designated COG as the operator of the Unit. Order No. R-21102 further pooled all uncommitted interests within the Purple Sage; Wolfcamp Gas Pool (Pool Code: 98220) underlying the Unit and dedicated the Unit to the Potato Baby State Com Well Nos. 704H, 705H, and 706H. The Division entered Order No. R-21102-A in Case No. 21312 on June 12, 2020, which conformed Order No. R-21102 to the amended order template described in the Letter of the Division Director dated April 9, 2020 (RE: Amendments to Compulsory Pooling Order Template). Since the entry of Order No. R-21102-A, COG has identified additional unleased mineral interest owners in the Unit that have not been pooled pursuant to the terms of Order No. R-21102.
50. 21526 Application of COG Operating LLC for compulsory pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all additional uncommitted interests in the Wolfcamp formation [Purple Sage-Wolfcamp Gas Pool (Pool Code: 98220)] underlying a standard 767.72-acre, more or less, horizontal spacing unit comprised of the E/2 of Sections 22 and 27, and the N/2NE/4 and Lots 3-4 (E/2 Equivalent) of irregular Section 34, Township 26 South, Range 28 East, NMPM, Eddy County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the to the following proposed wells: Potato Baby State Com #702H, to be drilled from a surface hole location in the SE/4SW/4 (Lot 4) of Section 34 to a bottom hole location in the NW/4NW/4 (Unit H) of Section 22; and Potato Baby State Com #703H, to be drilled from a surface hole location in the SE/4SW/4 (Lot 4) of Section 34 to a bottom hole location in the NW/4NW/4 (Unit B) of Section 22. Order No. R-21101 created a 767.72-acre, more or less, standard horizontal spacing unit consisting of the E/2 of Sections 22 and 27, and the N/2NE/4 and Lots 3-4 (E/2 Equivalent) of irregular Section 34, Township 26 South, Range 28 East, NMPM, Eddy County, New Mexico (“Unit”), and pooled all uncommitted interests within the Purple Sage-Wolfcamp Gas Pool (Pool Code: 98220) underlying the Unit. The Division entered Order No. R-21101-A in Case No. 21311 on June 12, 2020, which conformed Order No. R-21101 to the amended order template described in the Letter of the Division Director dated April 9, 2020 (RE: Amendments to Compulsory Pooling Order Template). Since the entry of Order No. R-21101-A, COG has identified additional unleased mineral interest owners in the Unit that have not been pooled pursuant to the terms of Order No. R-21101. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, the imposition of 200% charge for risk involved in drilling and completing each well, and Amending Division Order No. R-21101-A to reflect the changes identified herein. Said area is located approximately 13 miles south of Malaga, New Mexico.
51. 20964 Application of Overflow Energy, LLC for Approval of a Salt Water Disposal Well, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division approving drilling of a salt water disposal well and authorizing injecting water for disposal into the Devonian formation [SWD; Devonian (96101)], in Section 27, Township 22 South, Range 27 East, NMPM, Eddy County, New Mexico. Applicant proposes to drill the Rita SWD 1 well at a surface location 1876’ FNL and 807’ FWL of Section 27-T22S-R27E at a depth of 12,900 feet to 14,000 feet. Injection operations through the well will be conducted at an anticipated average daily injection pressure of 2,500 psi, and at a maximum of 2,580 psi. Applicant proposes injection of water at an average daily rate of approximately 20,000 bwpd and at a maximum daily rate of approximately 25,000 bwpd. The source of the injected fluids will be formation water from production wells that have been drilled and are scheduled to be drilled in the area. The well and lands will be located approximately 4 miles southeast of Carlsbad, New Mexico.
