PRELIMINARY DOCKET: Examiner Hearing for Thursday, June 3, 2021

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. Applicant in the above-styled cause seeks to vacate Order Nos. R-21517 and R-21518, and to pool the interests in the Bone Spring formation underlying a standard 640-acre, more or less, horizontal spacing unit comprised of the E/2 W/2 and the W/2 E/2 of Sections 30 and 31, Township 23 South, Range 35 East, NMPM, Lea County, New Mexico. The Unit will be initially dedicated to the following wells:
•    The proposed Red Bull 30-31 Fed State Com #2H well to be drilled from a surface hole location in the NE/4 NW/4 (Unit C) of Section 30, to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 31; and
•    The existing Red Bull 30-31 Fed State Com #3H well, which has been drilled from a surface hole location in the NW/4 NE/4 (Unit B) of Section 30, to a bottom hole location in the SE/4 NE/4 (Unit G) of Section 31.
The completed interval for the Red Bull 30-31 Fed State Com #2H well will remain within 330 feet from the quarter-quarter line separating the E/2 from the W/2 of Sections 30 and 31 to allow inclusion of the E/2 W/2 acreage in a standard 640-acre horizontal well spacing unit. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. Said area is located approximately 12 miles northwest of Jal, New Mexico.
6. 21904 Application of Colgate Operating, LLC, to Amend Order No. R-21354, Eddy County, New Mexico. Applicant seeks an order from the Oil Conservation Division for the limited purposes of amended Order R-21354 to allow for a one-year extension of time to commence the drilling of four wells under the Order. The Division issued Order No. R-21354 on June 10, 2020, which designated Colgate as the operator of the unit and the four proposed wells. The Order requires commencement of drilling the four wells within one year of the date of the Order unless Colgate obtains an extension by an amendment of this Order for good cause shown. Good cause exists for Colgate’s request for an extension of time due to current market conditions.

Applicant seeks an order from the Oil Conservation Division for the limited purposes of amended Order R-21355 to allow for a one-year extension of time to commence the drilling of four wells under the Order. Applicant in the above-styled cause seeks an order approving 1,280-acre non-standard spacing units to match the corresponding proposed Communitization Agreement for the acreage underlying Sections 27 and 34, Township 22 South, Range 32 East, NMPM, Lea County, New Mexico. Order No. R-21527 approved a 323.80-acre, more or less, standard horizontal spacing unit comprised of the N/2N/2 of Sections 3 and 4, Township 18 South, Range 32 East, in Lea County, New Mexico (“Unit”) and designated Mewbourne as the operator of the Unit. The Order further pooled the uncommitted interests within the Bone Spring formation (Young Bone Spring North Pool (Code 65350)) underlying the Unit, dedicated the Unit to the Eastwatch 4/3 B2DA Fed Com #1H well, and required Mewbourne to commence drilling the well within one year from the date of the order. 12. 21910 Application of Mewbourne Oil Company to Amend Order No. R-21528, Lea County, New Mexico. Applicant seeks an order amending Order No. R-21528, issued on November 13, 2020, to extend the deadline to commence drilling the authorized well until November 13, 2022. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Yeso formation, underlying a standard 320-acre horizontal spacing unit comprised of the S/2 of Section 26, Township 19 South, Range 25 East, NMPM, Eddy County, New Mexico. Applicant proposes to dedicate the above-referenced spacing unit to the following wells:

Applicant seeks to pool additional interest owners under the terms of Oil Conservation Division Order No. R-21053 (“Order”), which created a 240-acre, more or less, standard horizontal spacing unit comprised of the N/2S/2 of Section 13, Township 19 South, Range 28 East and the N/2 SW/4 of Section 18, Township 19 South, Range 29 East in Eddy County, New Mexico (“Unit”), and designated Mewbourne as the operator of the Unit. The Order further pooled the uncommitted interests in the Bone Spring formation (Grama Ridge; Bone Spring NE Pool, Code 28435) and dedicated the Unit to the following wells: Rattlesnake 13/18 B2LK State Com #1H, which will be horizontally drilled from a surface location in Unit L in Section 13, Township 19 South, Range 28 East to a bottom hole location in Unit K in Section 18, Township 19 South, Range 29 East; and Rattlesnake 13/18 B3LK State Com #1H, which will be horizontally drilled from a surface location in Unit L in Section 13, Township 19 South, Range 28 East to a bottom hole location in Unit K in Section 18, Township 19 South, Range 29 East. On December 15, 2020, the Division granted Mewbourne’s request for a time extension to commence drilling the wells authorized under the Order to January 31, 2022. Since the above-described order and extension were issued, Mewbourne has determined there are additional interest owners in the Unit whose interests should be pooled under the terms of the Order. Applicant in the above-styled cause seeks a year extension of time to drill the initial well under Order Nos. R-20643 & R-20643-A. The standard 200-acre, more or less, horizontal spacing unit is comprised of the Penasco Draw; San Andres Yeso Pool (50270) underlying the S/2 S/2 of Section 28, and the SE/4 SE/4 of Section 29, all in Township 18 South, Range 26 East, NMPM, Eddy County, New Mexico. The Orders limited the pooled vertical depths from a stratigraphic equivalent of a depth of 3,201 feet to the base of the Yeso formation at a stratigraphic equivalent of 4,460 feet measured depth, as defined in the Gamma Ray-Neutron Log from the Len Mayer 1 Well (API No. 30-015-05926). The spacing unit is dedicated to the Nirvana #3H well. Said area is located approximately 8.5 miles southeast of Artesia, New Mexico.

43. 21941 (Re-Open) Application of Colgate Operating LLC to Amend Order No. R-21405, Eddy County, New Mexico. Applicant seeks an order from the Oil Conservation Division for the limited purposes of amending Order No. R-21405 to allow for a one-year extension of time to commence drilling the wells under the Order.
